Invoice Factoring Brokerage Services

Haul Fund is an invoice factoring brokerage.

Haul Fund assists businesses seeking invoice factoring services by helping identify potential factoring companies, collecting information and documentation, assisting with the application process, answering general questions, and referring or submitting prospective clients to third-party factoring companies.

Haul Fund is not a lender, loan broker, bank, financial institution, or direct funding provider.

Haul Fund does not make loans, extend credit, purchase accounts receivable, advance funds against invoices, or directly provide invoice factoring.

Any factoring agreement, advance, reserve, factoring fee, credit approval, funding decision, or purchase of accounts receivable is provided directly by the third-party factoring company selected for the transaction.

Third-Party Factoring Companies

Haul Fund works with independent third-party factoring companies.

Each factoring company establishes its own:

• Eligibility and underwriting requirements
• Factoring rates and fees
• Advance rates
• Reserve requirements
• Contract terms
• Debtor or customer approval requirements
• Documentation requirements
• Funding procedures
• Recourse or non-recourse provisions

Haul Fund does not control a factoring company's underwriting decisions, approval requirements, pricing, funding schedule, or contractual terms.

Applicants should carefully review the factoring company's final agreement before entering into a transaction.

No Guarantee of Approval or Funding

Information provided through the Haul Fund website or by Haul Fund representatives does not constitute a guarantee of approval, funding, rates, terms, or availability of factoring services.

Submitting information or documents to Haul Fund does not create a factoring agreement.

Final approval and funding decisions are made solely by the applicable third-party factoring company.

Authorization to Process Factoring Requests

When you ask Haul Fund to assist with an invoice factoring request, you authorize Haul Fund to use the information and documentation you provide for purposes reasonably necessary to:

• Evaluate your factoring request
• Identify potentially suitable factoring companies
• Assist with completing a factoring application
• Submit information or documents to factoring companies at your request
• Communicate with factoring companies regarding your application
• Assist with questions, documentation, and transaction coordination

Information may be provided to third-party factoring companies and service providers as reasonably necessary to provide the brokerage services you requested and in accordance with our Privacy Policy.

Brokerage Compensation

Haul Fund may receive a referral fee, commission, brokerage fee, revenue share, or other compensation from a factoring company in connection with a successfully completed factoring relationship.

Unless separately disclosed in writing, compensation paid to Haul Fund by a factoring company does not change the contractual obligations between you and the factoring company.

SMS Messaging Program

Haul Fund offers an SMS messaging program for individuals who separately consent to receive text messages.

SMS messages may relate to:

• Invoice factoring inquiries
• Factoring applications
• Document requests
• Application status
• Factoring company submissions
• Approval or onboarding updates
• Funding-status updates
• Appointments
• Customer service
• Responses to questions you submit

Consent to receive SMS messages is separate from submitting a factoring inquiry and is not a condition of obtaining or using Haul Fund's brokerage services.

SMS Opt-In

When SMS consent is obtained through our website, you must affirmatively select the optional SMS consent checkbox.

The SMS consent checkbox will not be pre-selected and is not required in order to submit an invoice factoring inquiry or request brokerage services.

Providing Haul Fund with your telephone number alone does not constitute consent to receive SMS marketing or informational messages unless you separately provide the required consent.

Message Frequency

Message frequency varies depending on your inquiry, application, factoring transaction, and communications with Haul Fund.

Message and Data Rates

Message and data rates may apply depending on your mobile carrier and wireless plan.

Haul Fund does not charge a separate fee for receiving SMS messages from us.

SMS Opt-Out

You may stop receiving SMS messages at any time by replying STOP.

You may also use commonly recognized opt-out requests such as CANCEL, END, QUIT, or UNSUBSCRIBE.

After you opt out, you may receive one final message confirming that you have been unsubscribed. No additional SMS messages will be sent unless you subsequently provide new consent.

Re-Enrolling in SMS

Limitation of Liability

To the fullest extent permitted by applicable law, Haul Fund will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of our website or brokerage services.

Haul Fund is not responsible for the independent acts, omissions, underwriting decisions, funding decisions, servicing practices, collection activities, or contractual performance of third-party factoring companies.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.
